Blockwell

Building Safety Act 2022

Building Safety Act governance for resident-led boards

If your building is 18 metres or more, or has seven or more storeys, your RTM or RMC company may carry legal duties as an Accountable Person. Many directors are volunteers who took on the role to fix the service charge, not to run a safety regime.

Blockwell helps your board understand those duties, put them in the right hands and show it is overseeing them properly. We work alongside your managing agent and your fire and building safety specialists, not instead of them.

How we help

Two fixed-fee reviews. Each can be added to a Governance Risk Review or booked on its own.

For higher-risk buildings

Accountable Person Readiness Review

We check whether your board can show it knows its Accountable Person duties, has put them in the right hands, and is overseeing them.

Ten areas reviewed

  • Status and accountability
  • Board ownership and delegation
  • Risk assessment and management
  • Safety case report
  • The golden thread
  • Mandatory occurrence reporting
  • Residents
  • Building assessment certificate readiness
  • Fire Safety Order interface
  • Money, insurance and records

You receive

  • A written report with each area rated
  • A prioritised action plan showing who does what
  • A one-hour board briefing
  • Suggested minute wording for your board's arrangements
Each area rated Red Amber Green

For buildings of 11m or 5 storeys and above

Remediation & Leaseholder Protections Review

For boards with known or suspected defects. We check that the protections are understood, charges are handled correctly and the right parties are being pursued.

Six areas reviewed

  • Scope and identified defects
  • Leaseholder and landlord certificates
  • Service charge treatment
  • Funding and recovery routes
  • Board decisions and conflicts
  • Communications to leaseholders

You receive

  • A short rated report
  • An action plan with solicitor or surveyor referrals marked
  • A 45-minute board briefing

Neither review is a fire risk assessment, a structural or façade survey, or legal advice. Blockwell never acts as your Accountable Person or managing agent; where you need a specialist, the action plan says so.

For managing agents

You can commission either review for a client board. Whoever commissions it, the report goes to the board and the findings are the same. Blockwell does not pay or receive referral fees.

What your board is responsible for

In a higher-risk building, the Accountable Person must assess and manage the risk of fire spread and structural failure, and evidence how it does so.

Your managing agent can carry out much of this work. The board remains accountable for it.

Fees

Every fee is fixed and agreed in writing before any work starts. Half is paid on instruction and half when the report is delivered.

Both Building Safety Act reviews are quoted for each building. Tell us about yours on a free 30-minute call and we'll send a fixed quote.

The Governance Risk Review is from £750. When it is booked with the Accountable Person review, we quote one fixed fee for both, so higher-risk building work is never charged twice. We are offering a discount to our first clients.

Most boards pay for a review from the service charge, where the lease allows.

Frequently asked questions

Is our RTM company an Accountable Person?

Often, yes. An RTM company that has taken on management of the common parts will usually be an Accountable Person and may be the Principal Accountable Person. The position depends on your lease and what the freeholder keeps, so every review starts by confirming it.

Isn't this our managing agent's job?

Your agent can do much of the work, but the law places accountability on the company. Directors need to know what has been delegated, to whom, and how they will know it is being done.

We are already at tribunal. Can you help?

We can help the board organise its governance, records and decision-making. Legal strategy and representation are for your solicitor.
